After protests from some residents, officials in Durham, New Hampshire, have moved their town polling place. Initially, Durham voters were to cast ballots in the presidential primary and next fall's elections at the Durham Evangelical Church, but some said the church should not be used because it held a worship service involving noted homophobe Fred Phelps. The theme was opposition to Episcopal Gene Robinson's consecration because he is gay. WMUR

The court of appeals in Trumbull County, Ohio, has decided that Jacob Nash, born in a woman's body, remains a woman despite his sex change and may not legally marry in Ohio. His marriage license application with sweetheart Erin Barr was denied on New Year's Eve. Nash and Barr plan to appeal to the state Supreme Court. WYTV

Wisconson Senator Russ Feingold says he'll fight a constitutional amendment banning gay marriage. "It is unbelievable to me that we would use our Constitution to deal with an issue like that," the Democrat says. Us, too. gmtoday
